First National Real Estate Bundaberg is committed to protecting the privacy of our clients, customers, tenants, landlords, buyers, sellers, contractors and website visitors. We recognise the importance of handling personal information in a responsible and transparent manner and comply with the Privacy Act 1988 (Cth), including the Australian Privacy Principles (APPs).

1.2 What is personal information

When we refer to personal information we mean information or an opinion from which your identity is reasonably apparent, or that could reasonably identify you, whether the information is true or not and whether recorded in material form or otherwise.

The personal information we hold about you may also include credit information. At all times we try to only collect the information we need for the particular function or activity we are carrying out.

1.3 What personal information we collect

The types of personal information we may collect include:

  • Proof of identity, such as driver licences or passports, where required by law
  • Financial and payment information relevant to property transactions, tenancy applications or trust accounting
  • Employment details and references for tenancy or purchasing purposes

  • Website usage data and enquiry information
  • Tenancy application and screening information, including information obtained from tenancy databases such as NTD, TICA and Barclays MIS

1.4 Why we collect and use personal information

We will only use or disclose your personal information for the primary purpose of our business or for purposes related to our business activities.

1.5 How personal information is collected

Personal information is collected directly from you and, where necessary, from third parties such as referees, employers, landlords, tenancy databases and service providers.

1.6 Collecting through our websites

We collect limited technical information about website usage to improve performance and services. This information does not identify individuals.

1.7 Social networking services

We use social networking services such as Facebook, Instagram and YouTube to communicate with the public. When you communicate with us using these services we may collect personal information solely for communication purposes.

Each social networking service handles personal information in accordance with its own privacy policy.

1.8 Notification of collection from third parties

If we collect personal information from an entity other than you, such as a tenancy database, we will notify you where required and explain why the information is collected.

1.9 Use of Automated Decision Making (ADM)

First National Real Estate Bundaberg uses limited automated decision-making tools within approved systems including Rex CRM, PropertyMe and Reapit Lettings.

Automated processes may be used to support workflows, communications and preliminary screening only.

Automated decision-making tools are used as decision support only. All final decisions relating to tenancy approvals, leasing outcomes and property transactions are made by authorised staff members.

1.10 Tenancy databases

We use tenancy databases including NTD (National Tenancy Database), TICA and Barclays MIS to assess tenancy applications and manage tenancy histories.

1.11 Direct marketing and opt-out

You may opt out of marketing communications at any time by contacting us on 07 4152 1122 or emailing sales@fnbundy.com.au.

1.12 Disclosure of personal information

Personal information may be disclosed to landlords, buyers, sellers, tenancy database operators, service providers, professional advisers, regulators and the First National Real Estate network where required.

1.13 Overseas disclosures

We may use cloud-based systems and IT providers whose servers are located outside Australia. Reasonable steps are taken to ensure overseas recipients protect personal information in accordance with Australian privacy standards.

1.14 Access, correction and complaints

You may request access to or correction of personal information we hold about you. We do not charge any fees for access requests.

Privacy complaints may be made to our office. If unresolved, complaints may be referred to the Office of the Australian Information Commissioner.

1.15 Sensitive and unsolicited information

Sensitive information is collected only with consent or where permitted by law. Unsolicited personal information will be destroyed or de-identified where lawful.

1.16 Data security, retention and storage

Personal information is stored securely in electronic systems and physical files. We use reasonable safeguards to protect information from misuse, interference, loss, unauthorised access, modification or disclosure.

Personal information is retained only for as long as required for business, legal and regulatory purposes. When information is no longer required, it is securely destroyed or de-identified in accordance with applicable laws and industry retention requirements.

1.18 Changes to this policy

This Privacy Policy may be amended from time to time. Updates will not have retrospective detrimental effect on your privacy rights.
